Under Swiss law, companies have to protect their employees’ health and take all necessary measures to prevent psychosocial risks at work, and in particular, sexual and psychological (mobbing) harassment.
Art.328 of the Swiss Code of Obligations (CO) and Ordonance 3 of the Labour Law (LTO)
Following a decision of the Federal Court - jurisprudence of May 9, 2012, all companies/employers in Switzerland must put in place a system of prevention and treatment of psychological risks at work. The designation of an Ombudsman / “Personne de confiance en entreprise” internal or external to the company is a way to respond to this obligation as recommended by the SECO
